Labor Dispatch Contract (Chinese-English Bilingual Version)

根据《中华人民共和国劳动合同法》、《劳务派遣暂行规定》等相关法律法规，甲乙丙三方在平等自愿、协商一致的基础上，就劳务派遣事宜，订立本合同，共同遵守。
In accordance with the "Labor Contract Law of the People's Republic of China", "Interim Provisions on Labor Dispatch" and other relevant laws and regulations, Party A, Party B and Party C hereby enter into this contract on the basis of equality, voluntariness, and consensus through consultation regarding labor dispatch matters, and agree to abide by the following terms.
第一条 派遣期限、工作内容与地点
Article 1 Dispatch Period, Job Description and Workplace

第二条 工作时间与休息休假
Article 2 Working Hours, Rest and Leave
2.1 丙方在甲方实行（标准工时制/综合计算工时工作制/不定时工作制）。
Party C shall implement (standard working hour system/comprehensive calculation of working hours system/flexible working hour system) at Party A.
2.2 甲方保证丙方依法享有法定节假日、带薪年休假等休息休假权利。
Party A guarantees that Party C enjoys the rights to statutory holidays, paid annual leave and other rest and leave in accordance with the law.
第三条 劳动报酬与社会保险
Article 3 Labor Remuneration and Social Insurance
3.1 丙方的劳动报酬由乙方支付，工资标准为每月人民币_元（税前），支付日期为每月日。
Party C's labor remuneration shall be paid by Party B. The wage standard is RMB _ per month (pre-tax), and the payment date is the day of each month.
3.2 乙方应依法为丙方缴纳社会保险（养老保险、医疗保险、失业保险、工伤保险、生育保险）及住房公积金。
Party B shall pay social insurance (endowment insurance, medical insurance, unemployment insurance, work-related injury insurance, maternity insurance) and housing provident fund for Party C according to the law.
第四条 甲方的权利与义务
Article 4 Rights and Obligations of Party A
4.1 甲方有权根据工作需要和丙方的工作表现，在协商一致后调整丙方的岗位或工作内容，并应及时通知乙方。
Party A has the right to adjust Party C's position or job description based on work needs and Party C's performance after consensus through consultation, and shall promptly notify Party B.
4.2 甲方应为丙方提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品，对丙方进行岗位培训。
Party A shall provide Party C with working conditions that meet national standards for labor safety and hygiene, necessary labor protection equipment, and provide job training to Party C.
4.3 甲方应按照本合同的约定和法律规定，安排丙方的工作时间、休息休假，并支付相关加班费等费用给乙方。
Party A shall arrange Party C's working hours, rest and leave in accordance with the agreement of this contract and legal provisions, and pay relevant overtime pay and other fees to Party B.
第五条 乙方的权利与义务
Article 5 Rights and Obligations of Party B
5.1 乙方应如实向丙方告知派遣协议的内容以及与甲方约定的相关事项。
Party B shall truthfully inform Party C of the content of the dispatch agreement and relevant matters agreed with Party A.
5.2 乙方有义务按时足额向丙方支付劳动报酬，并依法为丙方办理并缴纳社会保险和住房公积金。
Party B is obligated to pay Party C's labor remuneration in full and on time, and handle and pay social insurance and housing provident fund for Party C according to the law.
5.3 乙方负责与丙方签订劳动合同，建立劳动关系，并处理与劳动关系相关的事宜（如工伤申报、劳动争议调解等）。
Party B is responsible for signing a labor contract with Party C, establishing a labor relationship, and handling matters related to the labor relationship (such as reporting work-related injuries, mediating labor disputes, etc.).
第六条 丙方的权利与义务
Article 6 Rights and Obligations of Party C
6.1 丙方有权获得劳动报酬、享受社会保险和福利，有权拒绝甲方的违章指挥、强令冒险作业。
Party C has the right to receive labor remuneration, enjoy social insurance and benefits, and has the right to refuse Party A's违章指挥 (违章指挥: directing in violation of rules) and强令冒险作业 (强令冒险作业: forcing risky operations).
6.2 丙方应遵守甲方的各项规章制度（但该规章制度不得违反法律法规），服从甲方的工作安排，按时保质完成工作任务。
Party C shall abide by Party A's rules and regulations (provided that such rules and regulations do not violate laws and regulations), comply with Party A's work arrangements, and complete work tasks with quality and on time.
6.3 丙方有义务保守甲方的商业秘密和与知识产权相关的保密事项。
Party C is obligated to keep Party A's trade secrets and confidentiality matters related to intellectual property.
第七条 合同的变更、解除与终止
Article 7 Modification, Termination and Rescission of the Contract
7.1 经三方协商一致，可以书面形式变更本合同。
This contract may be modified in writing upon consensus through consultation by all three parties.
7.2 派遣期限届满或本合同约定的终止条件出现，本合同终止。
This contract shall terminate upon the expiration of the dispatch period or the occurrence of termination conditions agreed in this contract.
7.3 甲乙丙三方解除或终止本合同，应依照《劳动合同法》等相关法律法规执行。
The rescission or termination of this contract by Party A, Party B, and Party C shall be carried out in accordance with the "Labor Contract Law" and other relevant laws and regulations.
第八条 违约责任
Article 8 Liability for Breach of Contract
8.1 任何一方违反本合同约定，给对方造成损失的，应依法承担赔偿责任。
If any party breaches the agreement of this contract and causes losses to the other party, it shall bear liability for compensation according to law.
8.2 乙方未及时足额支付丙方劳动报酬或缴纳社会保险的，应承担相应法律责任。
If Party B fails to pay Party C's labor remuneration in full and on time or pay social insurance, it shall bear corresponding legal liability.
第九条 争议处理
Article 9 Dispute Resolution
9.1 因履行本合同发生的争议，三方应友好协商解决。
Disputes arising from the performance of this contract shall be resolved through friendly negotiation by the three parties.
9.2 协商不成的，任何一方均可向有管辖权的人民法院提起诉讼。
If negotiation fails, any party may file a lawsuit with the competent people's court.
第十条 其他
Article 10 Miscellaneous
10.1 本合同一式三份，甲方、乙方、丙方各执一份，具有同等法律效力。
This contract is made in triplicate, with Party A, Party B, and Party C each holding one copy, all having equal legal effect.
10.2 本合同未尽事宜，按国家有关法律法规执行，或由三方另行签订补充协议。
Matters not covered in this contract shall be handled in accordance with relevant national laws and regulations, or by a supplementary agreement separately signed by the three parties.
10.3 本合同自三方签字或盖章之日起生效。
This contract shall become effective from the date of signature or seal by all three parties.
